Speak Your Mind NJ is a project of the New Jersey Psychological Association (NJPA).  We are allied with other mental health provider and consumer groups and individuals to improve access to mental health services and to protect patient privacy. 

Over the past two years, NJPA has met several times with insurance companies and state officials to share our grave concerns about patient confidentiality and restricted access to care. We have asked them to immediately stop harmful and unlawful case management practices that put profits and paperwork ahead of patient care.  Unfortunately, these discussions have not been productive.

As a result, NJPA recently filed a lawsuit (see the press release announcing the lawsuit) against the New Jersey State Health Benefits Commission, Horizon Healthcare Services, Inc. and Magellan Health Services for violation of patient confidentiality rights provided by the New Jersey Practicing Psychology Licensing Act.  We believe insurance companies and state officials improperly require mental health providers to turn over protected confidential mental health records of patients enrolled in the New Jersey State Health Benefits Program before authorizing treatment by a psychologist, continuing a course of treatment, or paying for services already provided. We are seeking a legal, declaratory judgment that these practices violate state law.

In addition to this lawsuit, we are also launching a new education campaign to alert New Jersey residents, mental health professionals, employers and policy makers to this crisis.   This website is the cornerstone of that effort.  We invite you to learn more, get involved, write letters advocating for easier access to outpatient mental health services, and make a donation to help protect patients, stop wasting taxpayer money, and protect patients' privacy.  You can also help by telling your story about the consequences of this mismanagement of care.
